Welcome to Luxury Gift Hampers, the website and online service of Luxury Gift
Hampers. (Luxury Gift Hampers, we, or us). This page explains the terms by which you may use our online website, and software provided on or in connection with the service (collectively the Service). By accessing or using the Service, you signify that you have read, understood, and agree to be bound by this Terms of Use Agreement (Agreement) and to the collection and use of your information as set forth in the Luxury Gift Hampers Privacy Policy whether or
not you are a registered user of our Service. This Agreement applies to all visitors, users, and others who access the Service (Users).

Delivery
Here at Luxury Gift Hampers, we provide safe and reliable delivery services for all our customers based in Sydney. All orders are processed within 2 to 3 business days (excluding holidays) and delivery will be within 3 to 6 business days depending on your location. All orders must be placed at least 2 weeks prior to your occasion to allow us to process your order and allow time for delivery. For any urgent deliveries please contact us via social media and we will do our best to service your needs. The suburbs we service are up to 35km Sydney wide. You can skip the delivery fees with free local pickup in North
Parramatta. After placing your order and selecting local pickup at checkout, your
order will be processed within 2 to 3 business days and ready for pick up within 3-6 days. We will contact you once your order is ready to be picked up.

Returns & Refunds
All hampers are non-refundable. In the event that your hamper or the products
arrive damaged or faulty, we will happily replace, exchange or issue a credit
depending on the extent of the damage. If you have any queries or concerns with the hamper(s) you have received, please contact us within 24 hours of the delivery time
on 0402 154 778 or email luxurygifthampers@outlook.com.

Cancellations
In the event that you need to cancel your order, we require 1 week notice before the delivery date, then we will issue a store credit. Orders that are cancelled after the 1 week notice, we will require a $10 administration fee.

Store Credit Terms and Conditions
Store credits are non-refundable, non-transferable and not redeemable for cash or other vouchers. When purchasing a gift, the full value of the store credit must be used and the outstanding balance paid by credit card.

Purchase of Alcohol
Luxury Gift Hampers supports the responsible service of alcohol. It is an offence to supply alcohol to or obtain alcohol on behalf of a person under the age of 18 years. If ordering hampers containing alcohol, you confirm that you are over the age of 18 years. It is a legal requirement that the person placing the order is over the age of 18 and the person receiving the delivery is over the age of 18. 

Payment Information – Taxes.
All information that you provide in connection with a purchase or transaction or other monetary transaction interaction with the Service must be accurate, complete, and current. You agree to pay all charges incurred by users of your credit card, debit card, or other payment method used in connection with a purchase or transaction or other monetary transaction interaction with the Service at the prices in effect when such charges are incurred. You will pay any applicable taxes, if any, relating to any such purchases, transactions or other monetary transaction interactions.

Security
Luxury Gift Hampers cares about the integrity and security of your personal
information. However, we cannot guarantee that unauthorized third parties will never be able to defeat our security measures or use your personal information for improper purposes. You acknowledge that you provide your personal information at your own risk.

Third-Party Links
The Service may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled Luxury Gift Hampers. Luxury Gift Hampers does not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access a third-party website from the Service, you do so at your own risk, and you understand that this Agreement and Luxury Gift Hampers Privacy Policy do not apply to your use of such sites. You expressly relieve Luxury Gift Hampers from any and all liability arising from your use of any third-party website, service, or content.
Additionally, your dealings with or participation in promotions of advertisers found on the Service, including payment and delivery of goods, and any other terms (such as warranties) are solely between you and such advertisers. You agree that Luxury Gift Hampers shall not be responsible for any loss or damage of any sort relating to your dealings with such advertisers.

General
Governing Law. You agree that: (i) the Service shall be deemed solely based in New South Wales, Australia; and (ii) the Service shall be deemed a passive one that does not give rise to personal jurisdiction over Luxury Gift Hampers, either specific or general, in jurisdictions other than New South Wales, Australia. This Agreement shall be governed by the internal substantive laws of the State of New South Wales, Australia, without respect to its conflict of laws principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. You agree to submit to the personal jurisdiction of a state court located in New South Wales, for any actions for which we retain the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of a our copyrights, trademarks, trade secrets, patents, or other intellectual property or proprietary rights, as set forth in the Arbitration provision below. Notification Procedures. Luxury Gift Hampers may provide notifications, whether such notifications are required by law or are for marketing or other business related purposes, to you via email notice, written or hard copy notice, or through posting of such notice on our website, as determined by Luxury Gift Hampers in our sole discretion. Luxury Gift Hampers reserves the right to determine the form and means of providing notifications to our Users, provided that you may opt out of certain means of notification as described in this Agreement. Luxury Gift Hampers is not responsible for any automatic filtering you or your network provider may apply to email notifications we send to the email address you provide us. 
Entire Agreement/Severability. This Agreement, together with any amendments and any additional agreements you may enter into with Luxury Gift Hampers in
connection with the Service, shall constitute the entire agreement between you and Luxury Gift Hampers concerning the Service. If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect.
No Waiver. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and Luxury Gift Hampers failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision.
